Flex Staff Ride With D.C. Police

On Friday night, Steve and I participated in a ride-along with Officer Brett Parson of the Metropolitan Police Department. (See cool pics here.) It was an opportunity we’d looked forward to for some time, and we were fortunate to have one of Washington, D.C.’s most talented and respected officers as our guide.

For better or worse, a Friday night in D.C. is never boring for the men and women of law-enforcement. We responded to a great variety of calls, some trivial or comical in nature, others extremely serious and frightening. Regardless of what comes in over the radio, you never know what you’re going to get until you arrive on the scene.

On a few occasions, an emergency call came through and we were treated to the horrifying experience of barreling through oncoming traffic at unbelievable speeds with the sirens blaring. I instinctively grabbed the door with one hand and the seat with the other, hanging on for dear life as pedestrians, buses, and other cars flew past in a blur. This alone was a strong testament to the stress police must endure on a nightly basis, as well as the training and special skills that officers must internalize in order to act decisively in emergency situations.

Of course, there’s an unofficial hierarchy of priorities which determine the haste with which each call is addressed. Generally, Officer Parson worked to “clear the board” which means he crossed into different zones and contacted the dispatch to offer his help following up on calls that hadn’t been responded to yet. Other nights of the week are less busy I’m sure, but I definitely got the impression that MPD officers spend much of their time just struggling to keep up with the calls that come in.

In this fast-paced climate, it’s easy to see how police can become hostile towards the constitutional rights of the citizens they encounter. Having encountered knife-wielding crazies and other dangerous folks, police often view the 4th Amendment as a nice idea that can’t realistically be followed all the time. We learned that many 4th Amendment violations are committed deliberately for the purpose of getting weapons off the street, and although no charges are filed, police feel that this conduct is necessary in order to protect the public. We disagree, of course, but it’s helpful to understand the rationales that underlie the police practices we oppose.

Officer Parson also demonstrated that he could legally stop almost any vehicle on the road by articulating the numerous traffic violations committed by passing motorists. He acknowledged that police commonly use these minor infractions as a pretext to investigate more serious crimes, but claims that police profiling usually relies on more subtle factors than race. He claims that his suspicions are usually correct, which I assume is how most officers justify making pretext stops.

These stops, like most invasive police practices, are legal if done carefully. While we certainly don’t condone pretextual policing, it’s important to recognize that officers will rarely if ever be reprimanded for doing this. In these situations, and many others, knowing your rights is absolutely the only protection there is. We can’t promise that it will work every time, but it might actually be easier than obeying all traffic laws.

In the course of our work, we’ve been exposed to countless horror stories about police encounters gone wrong. We always struggle to provide balanced information that emphasizes constitutional protections, while addressing the concerns of the public and respecting the hard work of law-enforcement. Overall, it was quite refreshing to witness the skill and heroism commonly associated with policing at its best.

Good grief! This is type of mentallity exactly what's wrong with groups like ACLU and Flex Your rights. You all seem to think that if a Law exists that makes you work harder than you feel you have to, then you have the right to ignore it. I was not suggesting that people should break traffic laws!

My point was that if the police want to pull you over, they'll find an excuse. Therefore, you should know your rights, because it's impossible to follow every traffic law every time.

How did I twist your words when I simply quoted them directly? After that I merely offered my opinion on what you had said, and the mentality that seems to cause people to say things like this.

How is it an excuse if they pukl you over for breaking the law? Breaking the law, is breaking the law no matter if it is only a failure to signal, tail light out, or no front liscense plate for instance. Any investigation that comes about after that, is on your own head.

That's you, accusing me of endorsing dangerous driving. Anyone who reads the post will see that I did no such thing. Yes, you quoted me, but the quote does not endorse dangerous driving as you suggest. My point is that even if you try very hard to obey traffic laws, you may still get pulled over and need to know your rights.

Our website and video repeatedly and deliberately advocate lawful driving. If you want to yell at people for advocating unsafe driving, go find someone who does that.

fishing expeditions

I call them "fishing expeditions". You don't have to be driving either. I've been out running in bad neighborhoods and found my run interrupted and threatened by police in three different squad cars. I've been walking downtown, accused of stalking a minor and threatened with arrest after a 50k race where I was hot, sweaty, and grimy looking. Admittedly, this was when I was younger[in my 30s] but it was also when we as citizens had more rights.

BTW, I got very hostile to the unscheduled post race activity and made several complaints to the DA that were totally ignored. It seems that such heavy handed behaviors are not only tolerated, but encouraged. Yeah, I didn't even get a written apology until I complained to the race director. For reasons possibly unrelated to this incident the "tough guy" police person who harassed me wasn't working there any more when I next raced in that town - nor was his immediate supervisor or the DA.

There is new legislation about allowing "coerced evidence" overseas against "hostile terrorists". It's the ONLY way we can fight over there. If they get that through, I'm sure that we can justify this type of legislation against "drug lords" here.

Handshaking?

Did they (or even talk about) shake hands with the residents of DC? Did they meet people on the streets, introduce themselves as our police officers here to serve and protect? Did they talk about any of the citizens in the city by first name? Did they seem to care about the people or more about impressing you with the stresses of the job they go through?

I don't think for a second police officers are not noble, but I do feel to really reduce the number of stressful moments they'll have to encounter on the job, they're going to have to meet us and not only be noble, but be a neighbor.

FWIW, Sgt. Parson does a great job of this "handshaking" thing. Because he's the official DCPD liaison to the gay and lesbian community, I see him all the time at gay-centered events, big and small, pretty much just doing rounds. I've seen him show up at big fundraising galas held in fancy hotels; I've seen him make an appearance at small gatherings at Mr. Henry's on the Hill. If he gets word of a non-private gay get-together, he seems to show up if only to say hi and make known that there's a GLLU. (Oh yeah, there were some times he didn't show up, but another member of the unit did instead.)

Recording the traffic stop.

I have a suggestion that I surprisingly didn't see on your site anywhere.

I carry a small inexpensive tape recorder in my vehicle at all times. When I see the "lights" come on I immediately turn the recorder on and place it in my breast pocket or on the dashboard. Many times an officer will lie and say that you consented to a search when you really didn't, and it's VERY hard to prove otherwise. However, with a recorder you have proof-positive. Be sure to mention the officers name at some point to link the recording to the traffic stop. i.e. "No sir Officer Brown, I never consent to searches of my property".

I gave this suggestion to a buddy of mine that was pulled over soon afterwards. When the officer saw the tape recorder he asked if the stop was being recorded. When my buddy (a black guy) said yes, he turned around, got back in his cruiser, and left. Cops don't want to be recorded!!

that is a really good idea. im 17 and got a traffic ticket a while back. the officer asked if i had been drinking and had me step out of the car. i passed the pen test and he said well, i heard you stutter your words a few times so im gonna have to have your friends step out of the car and im going to have to search it. and i replied with a "i wont let you search my car without a warrent" this really pissed him off but he must have saw there was no way he was going to be able to search my car. he gave me permission to get back in my car and handed me my ticket a few minutes later. better than having him find my chew or alcohol. i wish i would've known about the tape recording idea, i could've gotten screwed but when i got out i told my friend to lock my doors so it all worked out.

Recording a Traffic Stop

I think this is a very bad idea. NOT because it holds officers accountable, but because it is illegal to record anyone without their consent in the District of Columbia. I believe this is part of the Omnibus Crime Control and Safe Streets Act. I'm not exactly sure of all the specifics, but as I have learned, this prohibits recording anyone's voice without their permission. Do a search and maybe ask some people about it to be sure you are not in violation of the law before utilizing this idea.

Other than that, I feel that recording the voice of an officer is a sure way to get a ticket for any and all violations you have on your vehicle. Reason being, it presents an immediate sign of distrust to the officer if he/she notices it. And that is just as good as saying "please carefully check over my vehicle for violations, don't give me any warnings, and take your time."

I do understand your thinking process, but I think it may do more harm than good. Just make sure of the laws if you insist on this practice.

Not illegal to record a traffic stop

Neither the police officer nor the suspect are allowed privacy rights during a traffic stop, which is why video and audio evidence from a police officers dash cam are allowed in court. If you do a little research I'm sure you can find the supreme court ruling on this. I'll take it one step further, no jury would convict on any grounds for a recording of the incident. Because it is considered evidence of the crime or lack thereof.

Personally I see no problem with taping a stop. If this went to the US supreme court they would probably strike it down.

Of course you can say " this stop is being taped" if they don't want to consent you can tell them they have the right to leave =) However I think this would probably cause more trouble then it is worth. I think a hidden tape recorder in your vehicle is a pretty good idea, especially if you get illegally searched and your facing criminal charges from the search.
