An Offer For Barry Cooper

I propose the following addendums to Barry Cooper's advice regarding consent searches in Never Get Busted Again Vol. 1: Traffic Stops. This information is intended to help those who have private items that aren't well hidden, who are concerned that passengers may have stashed unknown items, or who have nothing to hide and wish to protect their 4th Amendment rights. I urge Barry Cooper to disseminate this information via his email list.
1. Be aware that consenting to a search means that you're waiving your 4th Amendment protection against unreasonable searches and seizures. If anything illegal is found after you've consented to a search, there will be very little your attorney can do for you. (Barry might add "so make sure your stash is well hidden!")

2. If an officer asks to search and you have private items that are not well hidden, always REFUSE consent. If you are searched and arrested after refusing consent, your lawyer can file a motion to suppress (throw out) the evidence in court. Many people don't realize how often illegally obtained evidence is declared inadmissible due to 4th Amendment challenges from skilled attorneys. If you believe a search would produce evidence against you, refusing consent is your best option.

3. If you've got nothing to hide, always refuse the search. This will offer a good low-stakes opportunity to test the professionalism of the police in your area. If you are searched illegally, nothing will be found and it will help police to recognize that innocent people have an interest in their privacy rights too. If you are searched, contact an attorney to discuss possible litigation. Challenging police misconduct is difficult, but essential if progress is to be made.
4. If you find it necessary to refuse a search for the reasons listed above, calmly state the following: "Officer I don't consent to any searches. Am I free to go?" If the officer responds with threats ("I'll bring a drug dog"; "I'll impound your car," etc.) calmly repeat your request to leave until you receive a response. If the officer says you may leave, depart immediately regardless of anything else he says. If you believe your rights are being violated, don't tell the officer. Do your best to memorize everything that is said and write it down the first chance you get. This will help your attorney help you.
While I remain opposed to the notion that consenting to a search is ever a good idea, it is notable that Barry Cooper only recommends this in one situation: a traffic stop in which the officer is corrupt and the driver has private items that are well hidden. By disseminating the above information, he can assist his audience with handling those common situations not addressed in the DVD.

I believe he'll agree with the recommendations above, and I look forward to his response.

Paragraph #1,2,3,4 is all solid, correct and good advice. Quoting the above... "If an officer asks to search and you have private items that are not well hidden, always REFUSE consent." The key is whether your items are well hidden or not. As mentioned in my dvd, if you have small amounts of marijuana hidden well then give consent. If you have 300 lbs of marijuana in the back of your mini-van as seen on my dvd, then refuse consent and hopefully a good lawyer can have the evidence suppressed as mentioned in Scott's blog above.

I want to clarify Scott's next to last paragraph. "While I remain opposed to the notion that consenting to a search is ever a good idea, it is notable that Barry Cooper only recommends this in one situation: a traffic stop in which the officer is corrupt and the driver has private items that are well hidden." This statement is partially correct. I recommend giving permission to search if your small amount of marijuana is well hidden regardless of the officer's integrity. First, it is impossible to know the integrity level of the officer you are dealing with until you have been dealt with which usually comes AFTER you've refused or consented. The integrity of the officer is unknown at the point consent is given or refused making it impossible to place this bit of information in your decision making process. Second, if you are dealing with an officer who you magically know has 100% integrity, upon refusal, he or she is more likely to get the K-9 who will alert on your auto and you will be searched more thourougly and by more officers because of the refusal. If you give consent, he or she might get the K-9 and might not (usually not) and upon a quick search of your car, you will be released. Again, I am trying to keep you out of the courtroom not preparing you for the courtroom.

Free to leave...
As mentioned in my dvd, interdiction officers are trained to issue a citation then ask for consent. The Supreme Court has ruled once a citation has been issued, the driver is free to leave so if the officer obtains consent while the driver is free to leave then it is less likely for the officer to be accused of coercing the consent which can lead to suppression of the evidence. When an officer has writtin you a citation, you are free to leave at that moment so leave.

We had 12 hours of great information on video that had to be reduced to 90 minutes. Traffic Stops Volume 2 will discuss the material in my current dvd in greater depth and will reveal many more great tips not included in Volume 1.

I think it is wonderful Scott Morgan has taken the time to get good information to the public to stop these unreasonable searches and arrests we are suppose to be protected from. Myself and NeverGetBusted.com share the same goal. Great job Scott!

This Might Help With The Consent Issue

This is an excerpt from a popular review of my DVD found at windypundit.com. The following quote is in reference to the 3rd chapter of my video. Mark Draughn writes:

"This chapter also has what's probably the most controversial piece of advice: Don't refuse the officer's request to search your car. That goes against everything I've ever read. However, on reflection, Cooper's argument isn't totally insane: As former defense attorney Ken Lammers has pointed out many times on his blog, you don't really have any effective Fourth Amendment protection against a search anyway when you're in your car.

I consented to a vehicle search once because I ran a stop sign late a night and would rather get searched than get a ticket. I assumed a ticket was guaranteed if I objected. Of course I could have still received a ticket but cops in my area are not typically corrupt.

What is your opinion on caving to a search to avoid a ticket?

In regards to "Terry Frisks" of vehicles, in 1983, the US Supreme Court ruled in Michigan v. Long , 463 U.S. 1032 (1983) that extended Terry v. Ohio, 392 U.S. 1 (1968) to allow searches of car compartments during a stop with reasonable suspicion. The case also clarified and narrowed the extent of adequate and independent state ground, allowing U.S. Supreme Court review of state supreme court decisions unless they explicitly appealed to state laws.

David Long was questioned by police after driving his car off a road and into a shallow ditch in Barry County, Michigan. Officers said he acted erratically and that he, "appeared to be under the influence of something." Noticing a hunting knife on the floor of the car, they conducted a "Terry" protective patdown (named after Terry v. Ohio), but they turned up no weapons. They then conducted a "protective search" of the car with the same justification: searching for weapons. Inside the car, police found an exposed bag of marijuana. In the trunk they found approximately 75 pounds more, and Long was arrested for possession.

I too have seized 1/2 kilo of cocaine, and 3k in cash under a driver seat during a Terry frisk of the vehicle.

There are numerous other USC rulings upholding Terry v. Ohio, and losses by defendants citing this case and Terry v. Ohio.

Barry asked me to post this, as there seems to have been a question regarding the applicability of Terry v. Ohio to vehicles.

Wrong !!!

The above case is NOT an account os a ' Terry ' search. The driver was nowhere near the vehicle and was no doubt handcuffed and in the back of a squad car when the cops did the ' protective ' search of the car. They were NOT looking for weapons so that they might be protected..the cops were in no risk of the driver jumping into the car and grabbing a gun or knife..There was NOTHING evident other than a hunting knife..nothing in plain sight. The cops were going to take the driver to jail anyway so a search was prior to towing as usual..but NOT a Terry search. When the defendant cannot get back into the car then the officers have NO business searching under Terry as no possible danger exists. Its just an excuse, as usual, for violating our Rights..Cops love to violate the law with impunity and harrass and falsely arrest people who do not show the right ' attitude '. I just hope that one day when the People have had enough of the cops violating our Rights for another arrest statistic that the hunters will become the hunted. The Courts are no help..only direct action will stop ' public servants ' from destroying our Constitution. My Dad was a cop for 30 years..I grew up in a police station..I have seen it all...What the cops will not do to ' win ' is a short list, regardless of Rights..I ALWAYS tell cops at DUI checkpoints and all other stops that I refuse all searches and I keep a video camera and tape recorder with me at all times driving so I can document the pigs actions..They HATE being filmed as they actually have to mind their P's and Q's and follow the law !! Just to let you people know that dont have a clue what your talking about. When a person is arrested, no matter if it be the driver or a passenger, you dont need concent to search, its automatic. So if we say a car is stopped and Barry Cooper is in the vehicle as a passenger and he is arrested for possession of Narcotics, then the vehicle is subject to search depending on the Officers descression.....

I've felt violated by a cop because I didn't have the right attitude. And I definitely don't agree with all of our laws. However, cops have helped many more times than they have violated me. Don't lose hope and be so bitter. Not all cops are bad.

They DO hate to be recorded...

I once informed some officers who were trying to enter my premesis without a search warrant that I am recording everything....they scattered, like the cockroaches that they are, away from the front door the second I told them. Six hours later, after I made them get a warrant they entered. I had nothing to hide, but why should I make it easy? They did all kinds of threatening to get me to open the door.
One time I was pulling into a Burger King in Stockton, CA with my black boyfriend driving the car, I'm white. I was 8 months pregnant and we were doing nothing wrong. We entered and spotted a van with undercover officers in it. Being a black man in Amerikkka- he changed his mind about eating there. As we pulled out of the parking lot, the pigs surrounded us and pulled us over. He is usually very cooperative with them, but I am not. They said he "fit the description" and I replied to the black officer in the group, "Yeah and so do you. You know better, you should be ashamed of yourself."
My boyfriend smokes marijuana and there is a permanent smell of it in the car. The officers said that the smell was grounds on searching the car. So he allowed them to search against my protests. They also wanted to search my purse. I had nothing but make-up in it but I still refused just on GP. He told me that he can because of the weed smell. I tell him that I don't smoke weed because I really don't and NO he can't search it. Finally after much shit-talking I let him, just to show him that he's wrong in telling me that I must be hiding something or why would I refuse a search? I let him search just so he can see that I just won't let him search just to exercise my rights and to buck him. This was years ago, it wouldn't happen now like this. I am an ACLU member and love sites like this and constantly educate myself. When I get pulled over now, I make sure that they see my ACLU card in my wallet as I show my license. That same racial profilind situation today would warrant a call to the ACLU from me. I have one question though. Was the officer right? If there is a weed smell in the car could he have searched my purse as the passenger?

Sometimes Responsibilities/Obligations prevent flexing rights

First of all I am all for flexing your rights and suggest that everyone invoke their rights. Over time people like us who are informed and refuse consent will have our day in court and eventually cops will have a case or hear of a case that did not favor them and may at least make them think twice about violating rights. But there are times when you have to submit to searches or tolerate unprofessional cops. If you are on the way to pick up your kids from school, on a short lunch break or as happened to me a few years back when I was responsible for taking care of my father when he was home on Hospice. Choosing to invoke my rights at the times when other people are counting on me is more of a selfish mission than a patriotic stand. At these times you should follow Barry's advice and make the decision where to stash and you should hide this well before you start the car. So many times people get into trouble because of bad planning. Everyone has bad luck sometimes but when bad luck seems to happen frequently it usually isn't bad luck but bad planning or irresponsible habits. If your car is maintained well meaning all lights are working and registration is up to date and if you wear a seat belt, go the speed limit and use your blinkers that should eliminate about 90% of reasons to get pulled over in the first place. I have seen Barry's DVD and it is very informative and explains so many more issues that go beyond consent. Barry's responses to comments aren't defensive. He also agrees with flexing your rights just as we all seem to be but we have all been pulled over and the reality is many cops take offense to you flexing your rights and some take it personally which means they become defensive and find a way to violate your rights just to show you who is boss. Also you might blow it by not practicing enough times on how tho handle these situations. In a cases like this consent or not make sure your stash is well hid. DC

I've seen Barry Cooper's DVD. I, like many, was more than a bit taken aback at the thought of consenting to a search. However, the logic seems pretty straight-foward, a cop is not as effective as a cop with a dog.
To me it was worth seeing just to learn about deception indicators. I would have never been conscious of that before.

On another tangent, When I google searched for his DVD I came across forums where it seems people are upset about Mr. Cooper making money from his DVD, what's the deal? He doesn't ask for donations.

I saw Barry's video and found it to be very useful. A little advice I would give is this. I completely agree with the consenting to search if you have something well hidden. I know from experience that when you tell a cop you'd rather not have him search 100 out of 100 times they will call the dogs. Just like he said. And if you smoke marijuana, whether it be at home or at a freinds house, and you go touch your door handle, you are screwed. Ive told my freinds much of what was in this dvd before I ever saw it. It doesnt matter if the dog indicates or not because you arent a k9 handler and therefore have no clue what the dog would look like even if it did indicate. They will search you if you dont consent. One night I was riding home and it was around 4 a.m. and I only had one headlight (big mistake that couldnt be fixed at 4 a.m.) and I rounded the corner with my brights on so I got pulled over for not dimming them. They didnt ever even ask me for consent. All I saw was a dog. Of course he hit on the drivers and passenger side door and my dumbass freind had left an ever so tiny piece of bud in the side of the door and there was shake in the floorboard. I had about a quarter I had put way down inside the a/c vent. The dog was scratching the hell out of the back of the console, but the cops thought it was shake and let me go. If you hide your shit well they wont find it and refusing to let them search is like signing up to have your car completely dismantled. Drug dogs suck. Its like a free search for cops because they can say whatever they want. Not too mention the door handle thing. I appreciate the advice Barry and am waiting for the next dvd.
