What should I have done
What should I have done, instead? I feel all was unnecessary!
I was traveling home after work with my boyfriend and two police cars were blocking the right of way on a double line (no passing) behind a truck which I guess they had pulled over. I stopped behind and check to see if it was safe to go around then proceeded around. I in turn was then pulled over and the officer stated that I was suppose to remain until told to pass. Neither of them were in the road with directions at the time. Well although, I was in the wrong for driving with a suspended license unaware that they do not get reinstated automatically after the 30 day period I was being ticketed for the suspension and given a court date. The officer asked if I consent to a search, I hesitated, He then said If you don't I will impound your car to the police lot, do a legal search. I said okay. They told me to call someone as I will have to get the car home or have it towed. I call my mother to come get me since I was not able to drive & boyfriend didn't have a license on him. My mother got there and they told her to stay in the vehicle, then proceeded to ask my passenger(boyfriend) out of car. He willing go out then they asked him if he had any items on him he stated no..Officer said empty your pockets and place him up against car to do a pat down search. My mother wanted to know why they were doing this also, He didn't do anything to provoke him & was just a passenger. The officer then started searching my car my mother wanted to know why they were searching the way they were, going through my purse, armrest, glove compartment, doors, under seats, grocery bags, etc.. she said she thought they could only search visible.
And as as mother was very verbal. The officer said that I consented, besides he could do so as I was arrested at this point & could have taken car anyway. I live in Florida (panhandle) and want to know if I was arrested (how do I know)they only said stand there until they finished writing the ticket, could I have said NO and what would have happened. I didn't have anything illegal.
I was just afraid to ask any questions. Also didn't want them taking my car as this would cost more for the tow, impound and storage on top of the fine, ticket and probably probation charges.
I would like to know for future it above were the same without the suspension, as my mother said she would have done the same thing.....GO AROUND!
