Illegal search of a vehicle
My son was pulled over for a routine traffic violation. He rolled through a stop sign. The officer called dispatch and found out that his license was "clear and valid". The officer told him "he was fine and that she was writing him a violation for rolling through the stop sign and a cracked windshield. After that, she called dispatch and they told her that he had a prior arrest for DUI and possession so she went back to his car and started asking him when was the last time he used pot. He told her back on the day of his arrest approximately a month ago. She then told him she didn't believe him and started to perform sobriety tests. (Standing on one leg and counting, walking heel to toe for nine steps back and forth) She then announced she wasn't convinced and arrested him and searched his car. My question is.... Was the search legal? She told him he was fine so she obviously didn't think he looked impaired. The only reason that she proceeded with accusations was because she found out he had a prior arrest and was with the same passenger.
