Marijuana: It's Still Illegal

New FBI data shows that more people were arrested for marijuana last year than ever before. It’s a harsh reminder that police still spend a lot of time and resources trying to catch people with small amounts of pot.

Flex Your Rights isn’t a "marijuana legalization" group, although you’ll probably never find us expressing adoration for the government’s massive war on marijuana. Rather, it is simply impossible to carry out our public education work each day without recognizing the role these laws have played in traumatizing peaceful Americans and creating an enduring demand for basic know-your-rights resources.

It's not just a question of guilt or innocence, or of whether someone uses marijuana or does not. The reality is that so often when police focus their energy towards the lowest & broadest rung on the criminal ladder, there will be collateral damage and opportunity costs. Critics of our work have often argued that, "If you have nothing to hide, you have nothing to worry about." But alas, a law-enforcement campaign of such magnitude can’t possibly be conducted in such a way as to avoid constantly inconveniencing and even falsely convicting the innocent. It happens all the time, which is exactly why all Americans must know their rights as long as this war continues and regardless of whether an individual actually ever uses or possesses marijuana.

Pot Bust

As a police officer now for 15 years I can say it is very rare that we bust anyone for small amounts of pot. Generally to get busted for pot you would have to be arrested for some other crime for us to add a possession charge. Or you would have to be disrepectful ass.

I would just like to respond to the "Officer". You say that you rarely bust people for small amounts of pot. That is true. You USE the possession of small amounts of pot as an excuse to violate the rights of public citizens to find larger crimes. Once you have validated a criminal activity through the possession of small amounts of marijauana, you then use the new-found powers of search and seizure you help to locate more volatile charges.

When you say you arrest few people for minor possession, you're leaving out the facts that the ones you DID arrest for minor possession are simply the ones you couldn't dredge up anything else on.

i got busted with some stuff

i got busted with some stuff in NJ and one of the things i got caught with was 2 grams of weed and they wrote down in the discovery 50grams or less and i got a felony charge, and i didnt get intent to sell or anything like that it was constructivly or knowingly possesing

Your accusation states that the "Officer couldn't dredge up anything else" when arresting someone for small amounts... This is a direct contradiction to his statement that if he DOES arrest someone for small amounts, it's because they were already arrested, and what he finds he has to report, or they were just being an ass. If he's trying to work with someone to find out info, and you're being an ass, you bet he's gonna bust you on that.

One more thing. Why is it so easy to forget that officers HAVE to uphold the law! This isn't a case where "if he was cool, he'd let me go." If he does not report something, he gets fired and his family suffers. Let's not forget that the possessor is the one who broke the law. If there was no fear of officers, there would be no control.
