Police Have Been Tasering Lots of People Lately

Horrifying videos of police tasering people are finding their way onto the internet with alarming frequency as of late. This one from Utah has caused quite a stir:



It's just awful to see the taser take the place of physical force, which would have been perfectly sufficient in this case. It's a torture device and it should never be used unless the officer perceives a direct threat to his personal safety.

While we don't condone the officer's handling of the incident, there are a few lessons to be learned from the suspect's poor handling of the situation:
1. Arguing over a ticket at the scene of the traffic stop is not in your interest. Deal with it in traffic court.

2. Signing a "promise to appear" simply means you agree to appear in traffic court or pay the fine. It's not an admission of guilt and refusing to sign it can get you arrested. Always read police documents before signing them, but don't get angry over a speeding ticket even if it's undeserved.

3. When told to place your hands behind your back do it immediately. Anything else you do could be considered resisting. The validity of the arrest can only be addressed in court, and you're more likely to get the outcome you want if remained quiet and calm.

4. NEVER inform the officer of your intention to sue him for excessive force or other forms of misconduct. The officer will prepare a story and the video evidence might even disappear. The officer should not find out about your suit until the papers have been served.

5. Don't demand to have your rights read to you. The officer will only read you your rights if you are going to be interrogated, which will not be the case for a traffic violation and most other arrests. You should already know your rights. Telling police how to do their job just pisses them off more, thereby strengthening their resolve to make sure the charges stick to you.
Our advice to remain calm during police encounters has nothing to do with your guilt or innocence. The fact of the matter is that people who lose control of their emotions get worse outcomes. As police around the country go increasingly taser-crazy, it becomes that much more important to know your rights and make smart choices in tough situations.

Be Calm and Corteous to Police...You Can Give Them Hell Later!

Bottom line: If a police officer is threatening you with force, comply. There is no way you're ever going to argue your way out of a ticket with a police officer. When your emotional (like this guy was), it's hard to articulate anything you are thinking. This is exactly what court is for, give your argument in a controlled calm setting, and let the much smarter (hopefully) judge decide if the ticket was warranted.
Not to mention, you have a good chance of the cop not even showing up to court if you contest it.
I don't agree with quick use of the taser, but this guy was an idiot to not cooperate. I mean did he think the cop was kidding, when he pulled out the taser? Furthermore, his refusal to comply (started walking back to his car)with the officer nullifies any validity with his original argument over the ticket. Once he disobeyed the officer, it's all out the door, including police misconduct(Unless the cop tased or beat the crap out of him, which he didn't). In court, this just looks like the cop "doing what he had to do" to control the citizen and get him to comply.

There is no way "physical force" here would have been sufficient. What was the cop going to do, take him down "mono y mono" until he got the cuffs on him? The officer was also outnumbered two to one. If he had a partner or back-up with him, I could see your point. Nevertheless, the office was by himself; engaging in physical force could have potentially endangered everyone in this encounter. Think about it, what if the man being arrested successfully resisted the officer's "physical force", or if the man's wife got involved? Things could have escalated to much more worse extent very quickly.
This brings me to my next point, enough with whining about tasering. I'm not a fan of it by any means, but the way it was used here was by no means "torture" as this website labels it. I'm sure it hurt like hell and the guy will be "butt hurt" about it for a long time, but he was fine. Trust me, he would have been in a lot more pain if he was sprayed with pepper spray and for a much longer period of time. It's not like the officer was abusing his use of the taser to the point of "torture". I'm guessing this guy experienced less than 10 seconds of pain. However, like the website says this all could have been avoided if the upset citizen would have recognized the fact that the officer was not fooling around. As soon as you calm down so will police officers, so be calm! I bet you, the officer would not have even arrested the man (after his refusal to sign it the first time) if he calmed down and signed the citation.
Nobody wants to lay down and take orders from anybody especially when you think you are innocent. But as this organization advocates, you don't prove your innocence to cops on the side of the road and refusing with their orders (if anything that'll be construed as guilt), you prove your innocence in court. Which no matter how much you hate it or how right you think you are, you always always comply with a police officer orders (as long as you're not incriminating yourself) especially when it is something as simple as putting your hands behind your back.

It's easy to sit at home behind your computer, watch this video and then assert your opinions as to what this police officer should, or should not have done. Secondly, from the very beginning the subject was out of hand and argumentative. Arguing doesn't do anything. You are allowed to ask questions, but I would not interrupt an officer during the performance of his duties, especially when he is trying to give you the answers to your questions to begin with. As far as backup....who know's where this video was taken. This could be some small town where backup is several minutes away. As far as using physical force before the taser, try to understand what all is going on in this officer's mind. The officer doesn't know if the driver has weapons, if the passenger has weapons, or if there are any weapons in the vehicle. Also, the two are standing on the side of, what appears to be, a busy highway. What happens when the officer goes to lay hands on the driver, the driver resists, and one or both of them fall out into the roadway in front of a car. I don't feel like the officer was right or wrong in the use of the taser. And I don't think that anyone else can rightfully argue for either side seeing as how we weren't there and don't know all of the circumstances. Just something to think about.

Tasers are meant to be used as a last resort, next to lethal force. In other words, if he didn't have a taser, should he have used a gun? No. Besides, he was not out numbered. The man's wife was pregnant; do you expect her to come out and get in a fight with a cop? She was obviously frightened, shown by her immediate compliance with requests.

The police officer did not even warn the man that he would be tased (as is policy), which he later lied to the other cop about. Tasers can, and have killed people before, and are therefore not something to be used lightly.

Great post. This video isn't an example of LEOs gone bad. I agree that the whole event could have easily been avoided if the guy would have understood both his rights and his responsibility to sign the ticket.

Pepper spray actually incapacitates you - it actively stops you from resisting by causing closing of the eyes and difficulty breathing.

Tasers cause temporary paralysis and pain. The point being the pain, so that you will willfully comply afterwards, for fear of further taser action.

So I say, when you cause pain as a punishment or to convince someone to act in a certain way, that's torture. When you cause pain as a side effect of actually disabling someone, it's not torture.

I agree strongly that the police should stop the use of tasars and stun guns immediatly. I also agree the use of pepper spray should be banned too. The .45 has always been much more effective at making the folks stop thier stupid behavior and it makes other potential criminals think twice if they realize they are putting their OWN lives at stake. I have a couple of stun guns myself, but they are a little dusty. I think the .45 is a much better means of protection for me and my family. We had better watch out for the liberals out there wanting to ban guns too. Negative. Pepper spray and tasers are both useful tools for law enforcement. To tell you the truth, those tools end up saving criminals a lot of discomfort. If I did not carry those on my belt I would be forced to use my ASP or Glock. I could also go "hands-on" with the suspect but someone usually gets injured. That will in turn result in the tax payers either paying the suspect's medical bills or my medical bills. I have been tazed at the academy at it is not that bad. After the five seconds there are no lasting effects. OC spray now I'm not going to lie..sucks. Again, there is no lasting injuries once you are decontaminated.

You know, this guy is a textbook example of what NOT to do. This is an excellent website, and everyone should know, and demand, that his or her rights be respected. However, there's a time, and there's a place, for all of that, and it's NOT on the side of the road. When you give a cop hell, and then walk away WHILE STICKING YOUR HAND IN YOUR POCKET, you get your issue because you asked for it...PERIOD.

The comment that tazers, OC, and any other less than lethal force tools be "outlawed" is a silly, knee-jerk thing to say. Then, there's two options, wrestle or shoot. Tazers have saved a lot of lives, believe that or not. Obviously, they need be used correctly, and this was a correct use of a tazer. I am no Democrat or Republican fan, and I guess my point of view is most likely Libertarian. And, I am a VERY STRONG proponent of 2nd Amendment rights, which is IMHO the most important section of our Bill of Rights. Tasers do have their place

I'm sure the guy would've enjoyed being beaten down by a baton or flashlight a lot less than being zapped.

I'm also sure there are a few cops out there who get their jollies out of the tazer, but they would probably get their kicks from beating suspects, instead. Since there's no lasting harm (assuming they don't fall head-first into traffic or get sat on and suffocated), the victim is a lot better off than if he had to get medical treatment for head injuries.

Its getting worse. I live in Utah, I've had the unpleasure of being tazed, and i can tell you, it was one of the most painful injuries I've had to deal with. I've had a busted hip,a busted bone in my back, I've had a real bullet, of .22, go into me in the stomach.
when I was shot with this tazor, i thought i had just been hit with a real bullet, I went down right away as the current stopped any and all reactions i had or could have had. I was pulled out of the car, still hurting, turned on my stomach, handcuffed, shackled then shot again with the tazor.
While in Jail, i met people, that had also been shot by these tazors, some of these men I met had even been hit in the face. Its not a good feeling, not at all. And in the video above, the poor man being tased, and his lady companion having to watch this is almost unreal, I watch it, and ask myself "why".
This is police brutality, that is and should be on the same level as the Rodny King beating that took place in LA.
The police are using these taser freely. Its inhumane, we as people, as human beings have rights, under God, and under the laws of the United States.
This needs to stop, not just with the tazoring, but also all the other things police, jail guards, correction officials, and other "othority figures", use for their own control.

If tazered do the following:
1.cross the wires.(causing the circut to short)
2.old farmboy trick.step in water if available sends the volts and amps back to the Tazer holder.(or make water to step in)
3. grab the tazer holder with one hand.(by his nuts if possible)zapping the piss out him and with the other grab the Tazer and hold down the button.
I do not recommend getting Tazered but if you make it ineffective they will stop using it.

I agree entirely with the poster's comments, however ... There must be other videos that will function more effectively as propaganda for this important issue. One, for example, where the victim is not such a COMPLETE ASSHOLE and will inspire more sympathy. I really, really hate to say it, but I felt a bit of pleasure when he got zapped. This is the kind of thing that happens when you have officers giving BS traffic tickets to raise revenue for the state. The guy was barely over the limit but the trooper was quick to give him a ticket.

The guy passed the reduced speed sign and had barely 5-8 seconds to slow down. This is called the typical speed trap that Utah is famous for. Look it up, Utah troopers write more speeding tickets than just about any other state mostly for BS radar tickets to raise money.

Both were right and wrong. This is an example of both the suspect and the police going overboard in an escalation situation which is something you don't want in a traffic stop.

He should have said for the guy to "Put your hands on the car and don't reach for anything or I am going to use force" and give him ONLY one warning instead of just pulling out the Tasar right away.

The warning will probably scare the guy from reaching anything more likely then not.

It's wrong to assume "everyone has a gun" because that will cause paranoia and is not healthy even for a police officer. He should just use his own judgment instead of relying on policy all the time.

In addition I have seen somebody been pulled over for a possible "Grand Theft Auto" The suspect stepped out when he was told and the officer didn't even handcuff the suspect while in the squad car and in the secure facility. nor did they bad mouth each other. COP vs Suspect.

I was at a concert last year in Houston, TX at a venue named Walters on Washington. The band playing was a two-piece, Two Gallants, folk-rock, far from any chaotic destructive noise, and was putting on a mild show.

There was a noise complaint, and the cop that showed to check it out, Officer Garcia, Tasered a 14 year old boy until he passed out from pain.

This incident , in my opinion, is a much more accurate case study in relation too taser discussion. (because it was super fucked up beyond any shadow of a doubt) The videos are on youtube, and me and some local people who actually give a shit about our community raised hell and even got some local news coverage on the event.

((The videos are all a little shaky, but i think it really gives a feel for the incident, like a member of the audience POV. The cop also tried to tackle the guitarist/lead vocalist of the band, who dodged him and bolted down the street, later to be picked up by local hooligans and aided and abetted. His drummer however, spent the evening in Harris County, for not running fast enough.))

I think that there is quite a bit of confusion of what a citation is. I written citation is a criminal complaint where the accused can actually sign the citation and make a later court appearance. What you are signing for is your promise (as an honest citizen who committed a traffic infraction) that you will not try to run from justice. Take it from me, if you are given a citation sign it and if you truly believe that the officer was wrong, fight it in court. Do not fight with the officer on the street, he is the one that will win in the end. Court is the place to argue your case, not on the side of the road. There are no comfortable chairs for the judge and jury to sit on the side of the road lol.

In this particular case I believe that the man retreating back to his car was an extremely stupid move. I have a family and I do not want to engage in a high speed chase. I do not want to put myself or others at risk. I also believe that the officer did not know what the driver intended to do. There is a problem when a driver refuses your directions. Most people will comply as law abiding citizens.
