Prosecutors: Not as Nice as You Thought

On Thursday, Scott and I attended a book discussion, signing and reception hosted by the Open Society Institute. The event featured Friend-of-Flex, Professor Angela J. Davis speaking about her new book, Arbitrary Justice: The Power of the American Prosecutor. In light of the Nifong imbroglio, the timing of her exposé is perfect.

As the former director of the esteemed DC Public Defender Service, Davis is a master player and observer of the vicious game that is the U.S. criminal justice system. By her own admission, she's "obsessed with prosecutorial power."

Her intent with Arbitrary Justice is to show how prosecutors have become the most powerful officials in the criminal justice system. In particular, Davis digs into the brutal arbitrariness of prosecutorial power and the utter lack of accountability for rampant prosecutorial misconduct.

The Nifongs, Davis insists, are common. The real story behind that case is that prosecutorial misconduct happens all the time and is rarely exposed. A disproportionate number of the victims are people of color; all of them lack the resources of the falsely-accused Duke lacrosse players.

Despite her intimate knowledge of the system, Davis seems stunningly devoid of cynicism and proposes practical prescriptions for change. She insists that folks who become prosecutors are not necessarily consciously racist or prone to evildoing. When she declared that her book wasn't meant to be an attack on the prosecutorial profession, someone hilariously heckled, "I want my money back!"

Davis is correct: Prosecutors aren't inherently bad; the system is bad. And bad outcomes thrive in any system where incentives are twisted. Such is today's criminal justice system, which rewards prosecutors who win convictions more than those who competently administer justice for justice's sake.

Davis identifies the major contributors to the system's dysfunctions:

Mandatory Minimum Sentencing

While prosecutors' plea bargain power has always provided them with lots of control over the outcome of criminal cases, their power to extract a plea -- and thus avoid a trial -- is intensified by the threat of mandatory minimum sentences.

Ironically, mandatory minimums were passed at the state and federal levels with the intent of eliminating sentencing disparities. The effect has been to shift the sentencing discretion to prosecutors without eliminating disparities.

Mandatory minimums have also been the driving force behind the exponential incarceration rates of the past two decades. The prosecutors haven't gotten nastier; their plea extracting tools have become increasingly menacing.

Political Prosecutors

A typical campaign for state attorney general involves a "tough on crime" Democrat facing off against a "tougher on crime" Republican. The electorate then votes based on their political affiliation.

Though these attorneys general are elected officials, few citizens know who they are or how they manage their offices. Moreover, because prosecutors have sole discretion over who gets charged and when, politically-motivated prosecutors frequently choose targets to enhance their political profiles rather than in the interest of justice.

Lack of Transparency & Accountability

Prosecutorial misconduct is widespread and unchecked. Davis notes that "Much of what passes for legal behavior might in fact be illegal, but because prosecutorial practices are so rarely challenged, it is difficult to define the universe of prosecutorial misconduct."

Ken Armstrong and Maurice Possley, the authors of a 1999 study of prosecutorial accountability concluded:

"With impunity, prosecutors across the country have violated their oaths and the law, committing the worst kinds of deception in the most serious cases...They have prosecuted black men, hiding evidence the real killers were white. They have prosecuted a wife, hiding evidence her husband committed suicide. They have prosecuted parents, hiding evidence their daughter was killed by wild dogs.

"They do it to win. They do it because they won't get punished."

The problem, as one editorial described it, "would be like trying to count drivers who speed; the problem is larger than the number of tickets would indicate." The problem is also difficult to quantify, because most of what the prosecutor does is behind closed doors. On the rare occasion when misconduct is discovered, judicial review is extremely limited.

"Of the eleven thousand cases of alleged prosecutorial misconduct examined by the Center for Public Integrity, the appellate courts reversed convictions, dismissed charges, or reduced sentences in just over two thousand. However, in these cases, most of the prosecutors suffered no consequences and were not held accountable or even reprimanded for their behavior."

Davis also points to another mundane reason why prosecutors are rarely held to account: Few defenders are willing to "snitch" on a cheating prosecutor. Making nice with the prosecution is generally in their clients' best interests. After all, it won't be long before they have to beg the same prosecutor to cut a better deal for their client.

It doesn't take a game theoretician with a PhD to appreciate how cheating would flourish in a criminal justice system where unscrupulous prosecutors are virtually immune from punishment and are rewarded with promotions and career advancement.

Reform, Davis insists, should at minimum, seek to eliminate the arbitrary exercise of prosecutorial discretion and establish incentives to strengthen the existing mechanisms of prosecutorial accountability. And she does the heavy lifting of proposing practical solutions. An essential part of her reform plan is to educate the public about the duties and conduct of their elected prosecutors.

It's too bad that the public only seems to pay attention when their prosecutors falsely indict innocent rich white kids for raping a black woman. Then again, if this incident lights sparks of nationwide prosecutorial reform, please pass the lighter fluid.

As a prosecutor in CA for over 19 years, I can tell you that the Nifongs of the world are the extreme exception, not the rule. Almost all of us work long hours under government office conditions for sub-standard pay not because we are power hungry or want to frame someone, but because we really care about the victims of crime and finding some sense of justice in the resolution of cases. Some of us are more 'fair' than others, certainly, but I have NEVER come across a case of another DA hiding evidence. There was a DA I knew who I felt contrived a case, however. I informed management; I don't know what they did. But that was one case, one in thousands upon thousands of cases. Is that one too many? Of course. But it is a man-made system; it will not be perfect. And believe me, it is way more biased in favor of letting the guilty go free than in convicting the innocent, which is as it should be. In fact, my very first training session with new deputies is to hand out Supreme Court cases on the obligation of prosecutors to be even-handed and just, thereby promoting the type of society we would all want to live in. There is a Duke cap sitting in my office to remind my trainees of how NOT to do things. You don't realize that the DA is your first line of defense against over-reaching police. We are the ones who bounce cases based on bad stops or insufficient evidence. I, myself, have been wrongfully arrested and was told by some piece of brass in LA that 'constitutional rights are something only lawyers argue about in court.' That was before I became a DA and I have never forgotten the experience. By slamming all prosecutors, you just come off like someone who wants criminals to get away with criminal acts, many of which are horrible and violent. You have no sense of proportion and thus no sense of justice. You would make a lousy DA.

Greg Borges' anger is appropriate. Federal prosecutors are far worse than state prosecutors because federal prosecutors' power is virtually unlimited. State prosecutors actually have to prove cases in trials from time to time. Fewer than 5 percent of federal charges are tested in court. About one in four state cases go before a jury.

Frankly, I don't understand why trial lawyers across America aren't taking to the streets to protest the perversion of the "justice system" and the assault on the Constitution. Well, actually I do understand...there's good money in representing all the folks getting rolled up in the various law enforcement crusades...and, as another poster noted, defense lawyers must toady to prosecutors because prosecutors have the power to make their jobs more difficult.

Falsely convicted citizens typically don't complain because of another sinister aspect of the system: the extortion clause in all plea deals...citizens once convicted must pretend they were guilty as accused, regardless of whether they actually were. If they don't pretend, the prosecutor can revoke terms of the plea deal and pursue whatever draconian punishment was avoided by taking the deal.

That power is based in the reality that negotiating a plea deal typically costs from $25,000 to $40,000 for legal fees. Going to trial typically costs upwards of $200,000...and going to trial typically means facing dozens or scores of additional charges, which further complicate the defense and thus drive up legal costs. The government can spend whatever it needs to to put you away. And if it happens to you, who are you going to complain to? Not politicians, they can't get elected if an opponent tags them as soft on crime. Not inspector generals in state or federal government; they're on the team. Not the newspaper (unless you're famous enough to merit a headline)...and newspaper cop/court reporters typically toady to cops and prosecutors and print their news releases mostly unchanged. Otherwise they'd lose access. Not judges; more and more, with appointments growing increasingly more political year after year. They're on the team, too.

Face it folks: Put all this together with the erosion of the Bill of Rights and we're fast becoming a police state.

My 16 year old son was ACCUSED of bruising his girlfriend's arm... He did NOT.

After many many THOUSANDS of dollars and 3 attorneys... We were able to prove that her mother gave her the bruise in an argument the evening before... She was afraid that a teacher would see it and call social services, so she came up with a plan which involved 3 of my son's girlfriend's friends.

They claimed that my son and his girlfriend had an argument and that he had grabbed her arm...

After a few days, just as kids do, they began to talk and brag to other kids who then came forward...

2 out of the 3 witnesses admitted the mother talked them into making the claim...

The prosecutor refused to drop charges.

After proving the 3rd witness was a liar, the prosecutor STILL refused to drop the charge... He never gave a reason, and cost us THOUSANDS!!

We were later told that this was normal and prosecutors have HUGE EGOS!

There are bad people in every profession. In my opinion and only based on what you wrote the prosecutor could have dropped the charges. However, you also have to realize how many times witnesses or victims recant their story down the road because they are scared. I cannot count how many times I have arrested someone for Domestic Assault only to have the victim say otherwise later. I go by the physical evidence at the time of the crime and the victim's statement/testimony. How do I or the prosecutor not know that the victim or witness was threatened into changing their story at trial?

Both police officers and prosecutors are not trained to lie, we are trained to the opposite. I was a police officer and am now a prosecutor. I wasn't power hungry in either position. Justice needs to be administered and it sounds like most of the people posting to this website are the usual people that think that they don't have to be accountable for their actions. Unfortunately, many defense attorneys are much more corrupt and dishonorable. They file frivolous Constitutional motions when there is no basis for the claim. They accuse prosecutors and police officers of lying simply because they are willing to lie, cheat, and steal to get their clients off. The system isn't as bad as you portray it to be. Of course, there are good and bad people in every profession, but to portray the entire class of attorneys who are employed as prosecutors as corrupt is to exhibit pure foolishness. In my office, ethical behavior is prized as the number one priority. Those in supervisory positions often teach classes in ethical behavior for the profession as a whole. We are bound by a much higher code than our opponents, who often want to deceive us and portray hardened criminals as saints that we should be sympathetic to.

Cops and Prosecutors are in a world of their own

I am currently being prosecuted for a crime I did not commit. My wife was selling some items at a bazzar and the police raided the place. They said that she had counterfeit items under state law (21 paris of sunglasses)... they weren't counterfeit. My wife is not a dishonest person. One of the cops got in my wife's face and said "You're going down!". She was in tears. I showed up and they said my wife was going to jail. I begged them to take me instead. The asshole cop (most of them are assholes) refused my plea. Then and FBI agent who was there at the bazarre listened to my plea. Against his better judgement, he suggested I go in her place. Mind you, I was not even there until they had already searched all through my wifes stuff and read her her rights. They took me to jail, booked me and I hired a lawyer. Several thousands of dollars, the d.a. is refusing to drop the charges even though he has no case. I told my lawyer to NOT plea bargain. My defense attorney is very well known and he said we will win this case. I hope so because I intend to sue everyone involved in this fiasco of justice. Should I be held accountable for my crimes? I say to the US Justice system, what crime???

I was recently charged with 4 felony from a real estate transaction the people were licnsed agents sold me a peice of property then claimed they did not I have been in civil litigation for almost a year when these scum bags go to the D/A and file a complaint to gain an advantage in the civil case all charges are false and the people who filed against me are involved in a flipping with straw purchasers defrauding banks the D/A star whitness the people call the investigator and say I was harrasing them and they are afraid the investigator goes to the D/A he goes to a judge and get an arrest warrent issued with 250,000 bail I have never been charged with anything in my life I find out about the warrent and it turn out I was not even in the city when these people say the harrasment occured I was arrested anyway even though I had a signed sworn statment from the family I was with there 18,700 outstanding felony warrents and the investigator from the D/A shows up at my house with 6 San Diego deputies and arrest me at the arraignment hearing the D/A calls me a bully even though we have never met tells my lawyer he want me to go to prison wants to raise my bail from 250,000 to 500,000 the judge sets it at 75,000 I remind you I have never been accused of anything before and it cost me $5,000 for the attorney $7,500 for bail and the D/ A whitness is the criminal the reason for this is that I wrote to the Grand Jury and asked for the D/A to be investigated for corruption and the D/A and his investigator are upset. this is going to cost me a fortune and that is what it is all about arrogant peices of shit who answer to no one and if you try to exercise your rights they do exactly what they are trying to do to me ruin me and my family the reason they issued the warrent was based on false information given by there criminal whitness I wasn't even in the city and it cost me $7,500 and I have to wait until trial to be herd where is the justice the crooks have the D/A in there back pocket and the dumb fucks don't even know it not only are the D/A's corrupt they are also stupid I will prevail but at what cost every time I stand up and say im inosent it gets worse.

Prosecutors over reaching their powers

Here in Washtenaw County Michigan we have a prosecutor who flaunts the fact that he has the power to decide what is or is not a "firearm".
Contrary to state law he has prosecuted citizens for having an (legal)airsoft gun on their property. Because most people don't have the financial means to fight this they give up. They have the gun confiscated, pay the fine and have this misdemeanor on their record for life. They are sold legally all over the state. Available at sporting goods stores, Cabelas etc..

How can we fight this?

I'm still dealing with....

After a full year, I am still fighting a royal screwing from a District Attorney in Massachusetts, who could have very easily verified my innosence. After the pre-trial hearing and asking for a motion to dismiss, I was told the the motion had been entered and "put forth for trial..." When the trial came, I was told by the District Attorney that the Commonwealth WAS going to prosocute.
During my testimony I told the Judge that the reasonable doupt of the case had been supplied by another nearby court system, which inadvertently 'triggered' the case at hand. It was explained to the District Attorney, that all she would needed to do to verify the facts, would be to make a phonecall, rather than maliciously prosecuting me "because she could" for her own personal gain. As a result, I've lost my Drivers License, my job (only income) ordered to pay several hundered dollars worth of fines, currently under threat of loosing my home and ALL personal posessions, and dealing with an ongoing chain reaction of problems, debts, more fees....rights violations, (both Constitutional and Civil) AND being refused ANY assistance that I would otherwise be entitled to. I have also been REFUSED unemployement benifits because of this as well! And would you believe it all started from a letter that my jackass mailman delivered to the wrong address (and fortunately? HAD BEEN RETURNED to sender rather than lost)
After being wrongly found guilty, by failure of the court to allow me to provide the evidence proving reasonable doupt, I filed a "Revoke and Revise" within half of the allowed time frame (dated copy with court stamp requested). They convieniently misplaced the document until more than 3 times the allowable timeframe had passed. And therefore REFUSING my rights AGAIN.
Because of this individuals greed for her own personal statistics, my life has been completely destroyed, with little hope for legal help because unless I'm allowed to sue the state for multiple rights violations, and gross repeatative neglegence, I will have absolutely no means to pay anyone for help. As it is...I can't afford to pay to be ABLE to excersize my rights. Yes...You DO HAVE TO PAY TO EXCERSIZE YOUR RIGHTS!

Bottom line...as long as the court has money coming in...they don't care how they get it! Guilty until proven Innocent in Massachusetts

I have dealt with law enforcement that were extremely kind, and professional, and were absolutely a credit to their profession. They up held the rights of the state, and my rights as a citizen, and prosecuted within the legally prescribed bounds set forth by legislators. And I have been thrown under the bus by a district attorney that rings up just about every thing he can as first degree felonies to see if your lawyer catches it. He asks for the maximum sentence for the level of offense you are actually guilty of, so there there is no grounds for appeal if you figure things out after you plea.. He then uses the stigma of the higher offense to brow beat you with all the fines, lengthy probation, community service ,et. al. and dismantles your life as much as humanly possible. These were drug charges. Prescription drugs from Mexico declared at the border and allowed entry by federal law.
