Drug Checkpoint Ahead? Relax and Keep Driving

Why? Because there isn’t exactly such a thing as a drug checkpoint. In City of Indianapolis v. Edmond, the Supreme Court found random drug checkpoints unconstitutional in 2000. Since then, police (particularly in the mid-west) have gotten into the habit of putting signs up warning drivers of upcoming drug checkpoints and then detaining and searching drivers who make illegal u-turns or desperately fling contraband from their vehicles. These checkpoint-like fake checkpoints serve as the functional equivalent of a checkpoint without violating the Court’s prohibition against checkpoints.

We’ve received several emails about this practice over the past couple years and we’ve mentioned it in our presentations, but perhaps this is something that deserves more attention. The prodigious Drug WarRant blogger Peter Guither encountered one of these non-checkpoints over the Thanksgiving weekend, and had some very interesting observations. Most notably, the sign warning of an upcoming drug checkpoint was located shortly before a rest area exit ramp, the intended result being that drivers wishing to avoid the checkpoint would pull in. Peter did not stop, but observed officers in the rest area parking lot using dogs to sniff approaching vehicles.

Peter theorizes, and I agree, that this practice may have been influenced by the Supreme Court’s recent ruling in Caballes v. Illinois, which held that police don’t need evidence to use drug-sniffing dogs during traffic stops. As practiced previously, the fake checkpoint tactic often took place on open stretches of highway, provoking illegal u-turns into oncoming traffic and the disposal of contraband onto the roadside. Discarded contraband not found by police could theoretically end up in the hands of children, or more likely, convicts on work detail. The high potential for collateral harm resulting from this tactic may have limited its implementation.

The 2004 Caballes ruling, however, assured officers that courts would approve probable cause searches stemming from warrantless dog-sniffs. By steering alarmed motorists into a canine-infested rest area, police could circumvent the need to trigger traffic violations as a pretext for drug searches. Obviously, not everyone entering the rest area was motivated by the checkpoint warning, but Caballes doesn’t require particularized suspicion.

Please warn your friends and family about these "drug checkpoint" signs, especially if they live in the mid-west. Keep driving and don’t look back is the best advice I can give. We’re likely to see more of this, and since the Court has not prohibited it, warning the public is our best defense.

Pulling off on an exit ramp after a sign

Hi Scott -- I first heard about this happening on a Burning Man email list, and in that instance the police posted the Drug Search Ahead sign, then hid behind bushes at the next off-ramp. Anyone who pulled off the side of the road at that exit, the police stopped and would try to search. A devious practice to be sure.

I had a cop, in full uniform, a few weeks ago, ask me if I knew anyone who wanted to sell some opiates (oxy's, perc's, phentanyl, etc) I didn't even know this guy. In full uniform (gun, badge,etc. ) I then witnessed him crushing up an oxycontin pill and snorting it in front of his 14 year old son. This is the same guy who arrests people who have pot in their car.

This is a true story! I wouldn't believe if I didn't see it myself!

Checkpoint

We have a checkpoint here in Vermont on I-91 just below the White River Junction exit. Any smuggler would know better then to take this route when there are so many other options. The equivalent checkpoint in upstate New York has had three deaths from truckers who couldn't stop in time and crushed someone waiting for their screening in a sedan.

They have Immigrations/customs agents standing in the middle of i-91 south (ten minutes south of white river junction) just peering into driver's cars and face as you approach them. DWI Checkpoints

When the Supreme Court found Drug Checkpoints unconstitutional, did this ruling include alcohol as a substance/drug? If so, what is the effect of this ruling (if any) on DWI checkpoints?

Good question. This is something I should have addressed in the post itself. DWI checkpoints remain legal on the premise that intoxicated drivers pose an immediate threat to public safety. Those in possession of drugs are not necessarily wasted or dangerous, thus the Supreme Court could not rationalize the monumental invasion of privacy involved in stopping everyone on the road just to find a little pot, etc.

This was the only good 4th Amendment ruling handed down by the Court in recent memory. Of course DWI checkpoints remain, and often serve as a pretext to look for drug offenders.

Pigs have learned to game the system more competently than the criminals.....particularly when they fabricate an officer safety issue. I had a rookie oinker (back-up pig at a routine daytime traffic stop in affluent Florida coummunity) lie about observing me reach under my car seat despite the fact the drivers door was wide open and both hands were in plain view. Another cop (casusal acquaintance from neighboring county) confirmed the fact this type of lawless conduct "happens daily across the country".

i live in the desert area of

i live in the desert area of southern california. They do several interesting things here. Firstly, they don't have drug checkpoints. they have DWI/registration checkpoints. They have typically done this between 2pm and 10 pm. Seems an odd time to try and catch drunks. Secondly, an issue came up about the amount of time people were being stopped in traffic(it backed up taffic for 10 to 20 minutes at times) and just randomly stopping people to check their registration. So a decision was made to annouce when these stops would be, so they would announce them on the radio, like the easy listening station and the talk radio station at 7 am in the morning and just once or twice. The argument being that you were warned of the checkpoint so you gave consent to be checked by driving on that road. Of course to go around them in my area would require a detour of about 12 miles or so. They havent had one in awhile though, so maybe legal action forced them to stop. It dont have all the information, just what i could pick up, and doing research about it seems about as easy as drinking beer through a rock.

"Safety Checkpoints"

The police in my town (Clifton, NJ) sometimes set up what they call "safety checkpoints." What they do is set up a checkpoint and stop all cars coming down a particular street. Then the officer walks over to the cars and checks for visible traffic infractions, such as expired inspection sticker,no seat belt, or tail light out. I must emphasize that at the time they signal the car to slow down and stop, none of these violations would be visible.

I'm wondering if these checkpoints are legal. I've been stopped in three of them and ticketed twice. Any thoughts?

Also, I'm wondering if there are sources of info on exactly what to do and not do if I am stopped at a DWI checkpoint. My town is also setting them up. If I have had, say, one glass of wine with dinner and nothing else, should I disclose that when questioned? Can I demand that the Field Sobriety Test be videotaped in case I disagree with the judgment of the officer? Can the police ask to search my car? What happens if I refuse to allow the vehicle to be searched without a warrant? Can I ask for a supervisor to be there during the search? Will that protect me from having something planted in the car by the officers? If I do allow the search, can police place me "in custody" while they do the search, even without actually arresting me?

I have a lot of other questions, but these'll do for starters. Funny, I used to be a supporter of the police until I ended up on the receiving end of behavior which I consider questionable. Thanks.

The most enjoyable video on YouTube is titled "Cop vs Cop" and involves an example of a corrupt cop conducting a traffic stop on I95 near Orlando. This traffic stop has been featured on TV but the voiceover on some shows (including YouTube) may not be accurate. It involves a black cop from Miami who was traveling North in his personal vehicle who became the victim of a criminal-in-uniform engaging in illegal profiling and falsifying traffic infractions to justify his criminal behavior. This is a perfect examle of the corrupt swine drug lottery: cops breaking the law hoping to make a drug bust and sieze assets.

THE SEVEN important FACTS regarding this lawless traffic stop are listed below, which may not be consistent with the video description.

1) Black cop traveling North near dusk on I95.

2) White pig (engaging in illegal profiling) notices a negro in a shiny new SUV. The corrupt pig is hoping the blackman is a drug dealer so he (once again) plays the dirty pig lottery by fabricating two reasons to pull the motorist over: improper lane change (failing to signal) and illegal license plate frame.

3) The black guy immediately realizes what is going on and gives the white cop trouble.

4) The matter ends up in court where it is revealed the white pig was formerly instructed by a judge he cannot stop cars for a license plate frame that HE deems illegal. In other words: a judge warned him to stop this practice. This corrupt pig should have been fired and jailed for failing to heed the directive of a judge, but he probably ended up with a promotion.

5) The jury did not believe his BS about an improper lane change and also determined he was engaging in illegal profiling.

6) The black cop was convicted of a petty misdeanor.

7) The black cop sued and was awarded damages.

A few years after seeing this video for the first time on television I saw another pigvid which featured the SAME prick cop. Although this corrupt oinker should have been banned from law enforcement he undoubtedly continued to rise through the ranks of the swine farm. I can only hope the next time I read about him will be in some obit column, since the public should never lament the slaughter of corrupt swine in uniform.

The taxpayers are losing millions every year due to police misconduct. The last time I researched the issue Detroit was leading the nation with payouts due to the lawless actions of uniformed swine.

On my way to a wedding in Las

On my way to a wedding in Las Vegas from LA, I saw a 'drug checkpoint' sign on I-15 North on the right side of the road, I think it was between Barstow and Baker. It was definitely within a couple miles of an upcoming rest area, on a large stretch of open desert freeway on the other side of the legit south I-15 agricultural checkpoint.

The point is, there was no 'checkpoint' anywhere, all the way to Vegas. I think you are right about it being a scare tactic to provoke aberrant or suspicious behavior. Hardly the way to catch a drug king-pin. Makes me sick.

I had an small amount of POT with me. And I was crapping my pants. Just like many of the stories above there were 4 or so signs proclaiming "drug checkpoint ahead", "K9 Dogs in use". Also there was a exit immediate following the signs. Which my wife wanted to take. I said just keep on trucking as I thought there was no way they could stop every car. Sure enough there was two cops on the other side of the exit waiting for anyone suspicious to exit. Further down the road there was a camper pulled over being swarmed by dogs. They most have tossed something out the window (poor bastards). I thought to myself this shit can not be legal. So here I am doing the follow up research and you have confirmed my suspicions. Thank you for your good information and I will be sure to tell everyone I know to do what I did and keep on drivin! BTW my incident was on I-29 North right before Souix Fall, SD.

Checkpoint outside of Charlotte

I had a similar experience two months ago on a small highway outside of Charlotte, NC. Signs said "K-9 Checkpoint Ahead". I turned at the next intersection, and was stopped right away. They asked for my license and were walking around my car, when another car pulled up behind me.

You should've seen these cops jump when they noticed the car behind me was full of young black guys, the driver with big, fat dreads. They immediately handed me my license with no further questions, and surrounded the other car. As I drove away, I saw them pulling the guys out of the car, pushing them against the hood, and frisking them.

Though I'm lucky to have not been subject to the same abuse, it's obvious who they were looking for, since the car was not any more suspicious than mine except for the race of the occupants, and they were willing to ignore a young white punk with multiple piercings and oversized sunglasses in lieu of a car full of black dudes. I was SHOCKED at the whole situation.

I ran into one of these, exactly as you describe, a few years ago. I reacted, taking my foot off the gas, but somehow stumbled through the correct thought processes in time to avoid the exit ramp. Saw a guy pulled off the road diving into his u-haul trailer, just his feet hanging out! As I drove on, I saw a cop in an unmarked car on the other side of the opposite lanes giving me the eyeball. No problem except a totally ruined buzz.

drug addictions

I suppose it sounds that easy, but people behave differently in such situation. There are quite a few who can keep calm in this situations. And it's mostly the real addicts. I've worked at Narconon Vista Bay and I can tell you, drug addicts look far more normal that usual people

I encountered a checkpoint warning sign in KS last summer. I did pull off at the exit just after the sign. I was clean, but didn't want to get caught up in traffic. I was immediatly pulled over by an unmarked car. The cop gave me a choice. I could cop to the drugs, (I had no drugs), or the dogs would be called. In either case, he said I was screwed. I was shttin my pants. I figured if they didn't find anything, they were going to plant something to avoid lookin stupid. I said I didn't have any drugs and he said, yes you do. They brought the dog. The dog was acting normal. The other cop then starting provoking the dog and it finaly started barking. They then started to search my car. They trashed it -I mean destroyed it. riped the door panels out, pulled the back seat out, just trashed it. He said they could take me in for traces that the dog identified. I said nothing. They had me handcuffed sitting on the side of the road for 3 hrs. finaly let me go, but I couldn't find my keys, they locked them in the trunk. I had to have my car towed. It was total bullshit.
